Random Racing Club Terms of Use

1. Introduction and Acceptance
These Terms of Use ("Terms") govern your access to and use of Random Racing Club ("RRC"), powered by RAFA — including the RRC web application (at randomracingclub.com), our Discord community, our email and SMS communications, our merchandise store, and any events or programs we operate (collectively, the "Services").
By creating an RRC membership, clicking "I agree," or otherwise accessing the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
RAFA Racing Club LLC ("Company," "we," "us") operates RRC. We reserve the right to modify these Terms at any time. See Section 14 (Changes to Terms).
2. Eligibility
2.1 Age Requirement
You must be at least 16 years old to create an RRC membership or use the Services. By creating an account, you confirm that you are 16 or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly permit individuals under 16 to use the Services. If we discover that a member is under 16, we will terminate their account and delete their data.
[NOTE FOR COUNSEL: Confirm the minimum age (13, 16, or 18) in light of COPPA, GDPR Article 8, applicable state law, and the nature of the Services — particularly Discord participation and merch purchases. 2.2 Capacity to Contract
You represent that you have the legal capacity to enter into a binding agreement in your jurisdiction. If you are accessing the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
2.3 Geographic Eligibility
The Services are available globally, subject to applicable laws. You are responsible for compliance with local laws in your jurisdiction. [NOTE FOR COUNSEL: Are there any jurisdictions where the Services should be explicitly unavailable, e.g., OFAC-sanctioned countries?]
3. Account and Membership
3.1 Account Creation
To access most RRC features, you must create a membership account. You agree to provide accurate, complete, and current information at signup, including your name, email address, and ZIP/country. You are responsible for maintaining the accuracy of your account information.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at privacy@randomracingclub.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
3.3 One Account Per Person
Each individual may hold only one RRC membership account. Creating duplicate accounts is prohibited.
3.4 Member Number and Founder Status
Upon successful signup, you are assigned a unique sequential member number. Members who join within the first 150 spots are designated "Founders." Your member number is a permanent identifier associated with your account for the life of your membership. It is non-transferable and has no monetary value.
Founder status is a recognition of early membership; it does not confer any ownership interest, equity, voting rights, financial return, or guaranteed benefits beyond those described in the Services at the time of designation. We reserve the right to add, modify, or discontinue Founder-specific benefits with reasonable notice.
3.5 Free Membership
RRC membership is free to join. Access to Discord, the web profile, event RSVPs, sim racing signups, and the newsletter requires no payment. Certain products and experiences (merchandise, event tickets, physical welcome kits) are offered for purchase separately and are subject to applicable purchase terms.
4. Community Rules and Conduct
4.1 General Standards
RRC is a community built on the principle of welcoming everyone into motorsport — regardless of experience level, budget, background, or identity. All members are expected to treat each other with respect. Harassment, hate speech, discrimination, threats, and toxic behavior of any kind are prohibited and may result in immediate suspension or termination of your membership.
4.2 Discord Community Rules
Your participation in the RRC Discord server is governed by these Terms, Discord's own Terms of Service (https://discord.com/terms) and Community Guidelines (https://discord.com/guidelines), and any additional channel-specific rules posted within the server. Discord rules posted in the server are incorporated into these Terms by reference. We reserve the right to remove any member from the Discord server for violations of these rules.
4.3 Prohibited Conduct
You agree not to:
- Post or share content that is unlawful, defamatory, obscene, threatening, or discriminatory
- Impersonate any person, driver, team, brand, or RRC personnel
- Use the Services to send spam, phishing messages, or unsolicited commercial communications
- Attempt to gain unauthorized access to any part of the Services, other user accounts, or our infrastructure
- Scrape, harvest, or collect member data without authorization
- Use the Services to promote competing communities or services without our prior written consent
- Engage in any conduct that could damage the reputation of RRC, RAFA, or their brands
- Violate any applicable local, state, national, or international law
4.4 User-Generated Content
By posting content in the Discord server, on the web app, or elsewhere within RRC Services, you grant RAFA Racing Club LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Services. You represent that you own or have the rights to post such content and that it does not infringe any third party's rights.
5. Sim Racing Events
5.1 Participation
RRC hosts casual sim racing events, including but not limited to Tuesday Night iRacing sessions, Race the Driver events, and themed sim league events. Participation in sim racing events is voluntary and free (except where an event ticket is required, as disclosed at registration).
5.2 Casual Nature
RRC sim racing is designed as a casual, inclusive fan experience — not a competitive esports ladder. We do not guarantee placement in events, access to specific opponents (including RAFA drivers), or any particular outcome. Event formats, drivers, and schedules may change at any time.
5.3 Third-Party Platforms
Sim racing events may require the use of third-party platforms (e.g., iRacing, Assetto Corsa, Simracing.GP, GridFinder). Your use of those platforms is governed by their respective terms of service. We are not responsible for third-party platform availability, performance, or policies.
6. Events and Trackside Meetups
6.1 Event RSVPs
RSVP for RRC events does not guarantee admission unless otherwise stated. For ticketed events, your ticket constitutes your reservation.
6.2 Ticketed Events
Some RRC experiences — trackside meetups, Race the Driver weekends, sim nights with limited capacity — may require a paid ticket. Ticket purchases are subject to the specific event's purchase terms displayed at checkout, including any refund or cancellation policies. 6.3 Event Conduct
At RRC events, you agree to follow all venue rules, applicable laws, and instructions from RRC event staff. RRC is not responsible for personal injury, property damage, or loss at events except to the extent required by applicable law.
6.4 Waiver / Release
[NOTE FOR COUNSEL: Determine whether a separate event waiver and release of liability is required for physical events, particularly those involving motorsport facilities or track access. This section is a placeholder — counsel should draft the appropriate release language.]
7. Merchandise and Purchases
7.1 Shopify Store
RRC merchandise is sold through a Shopify-powered store. All merchandise purchases are subject to Shopify's terms as well as the specific product terms, pricing, and shipping policies displayed at the time of purchase.
7.2 Pit Pass Kit and Physical Welcome Kits
The Pit Pass Kit (physical welcome kit including your unique member number artifact) is sold separately at a one-time price. The kit is limited in quantity and availability. Purchase of the Pit Pass Kit does not upgrade your membership status beyond what is described in these Terms.
7.3 Limited Drops and Capsule Merchandise
RRC may offer limited-edition merchandise drops ("drops") in collaboration with RAFA brands and outside partners. Drops are sold on a first-come, first-served basis in limited quantities. All sales are final unless a defective product is received. We do not guarantee availability or restock of any drop item.
7.4 Refunds and Returns
[NOTE FOR COUNSEL: Specify the return/refund policy for merchandise, Pit Pass Kits, and event tickets. Consider whether a standard 30-day return on unworn/unused merchandise is appropriate, and what the policy is for defective items.]
8. Intellectual Property
8.1 Our IP
All content, branding, design, text, graphics, logos, and software associated with RRC and the "Random Racing Club" name, together with the "powered by RAFA" lock-up, RAFA marks, and all associated intellectual property, are owned by RAFA Racing Club LLC and/or its affiliates and licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited license to use the Services for their intended purpose.
8.2 Your License to Use the Services
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.
8.3 Feedback
If you submit ideas, suggestions, or feedback about the Services, you grant us an irrevocable, royalty-free license to use that feedback without obligation to you.
8.4 DMCA / Copyright Complaints
If you believe your copyrighted work has been posted within the Services without authorization, please contact us at [DMCA/COPYRIGHT CONTACT EMAIL] with the information required by the Digital Millennium Copyright Act.
9. Privacy
Your use of the Services is subject to our Privacy Policy, located at [PRIVACY POLICY URL]. The Privacy Policy explains how we collect, use, and share your personal information, and how you can exercise your data rights. By using the Services, you acknowledge that you have read and understood the Privacy Policy.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE DO NOT GUARANTEE THAT ANY RAFA DRIVER OR PERSONALITY WILL PARTICIPATE IN ANY SPECIFIC SIM RACING EVENT, MEETUP, OR COMMUNITY ACTIVITY. DRIVER AVAILABILITY IS SUBJECT TO CHANGE WITHOUT NOTICE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAFA Racing Club LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM OR (B) [ONE HUNDRED DOLLARS ($100)].

12. Indemnification
You agree to indemnify, defend, and hold harmless RAFA Racing Club LLC and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) your User Content.
13. Termination
13.1 By You
You may terminate your RRC membership at any time by contacting us at privacy@randomracingclub.com and requesting account deletion. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
13.2 By Us
We reserve the right to suspend or permanently terminate your membership and access to the Services at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in conduct harmful to the community, or for any other reason permitted by applicable law. We will endeavor to notify you of terminations except where prohibited by law or where notification would compromise the integrity of an investigation.
13.3 Effect of Termination
Upon termination: your right to access the Services ends immediately; your member number is retired; any unused event tickets or merch credits may be subject to the applicable refund policy; and Sections 4.4 (User Content license), 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law), and 16 (Dispute Resolution) survive termination.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (if you have provided your email address) and by posting a notice on the Services at least [30] days before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Services.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of [GOVERNING JURISDICTION], without regard to its conflict-of-laws provisions. 16. Dispute Resolution

Counsel should decide on and draft: (a) whether mandatory arbitration is appropriate for RRC's member base and legal posture; (b) whether a class-action waiver is appropriate and enforceable in the target jurisdictions; (c) whether a small-claims exception should be included; (d) the forum and rules for any arbitration (e.g., AAA Consumer Rules). Some jurisdictions limit the enforceability of mandatory arbitration clauses in consumer contracts — counsel should advise on jurisdiction-specific risks.]

17. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and any applicable event terms or purchase terms, constitute the entire agreement between you and us regarding the Services.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
